| 中文摘要:数字技术深度革新人类认知与社会交互方式，身联网场景因其扩张所产生的数据资源兼具个体、企业、社会三重属性备受关注。在个人信息保护与社会效益实现双重张力下，规则近乎空白，如何监管仍需考量。宽松监管个体将承担重大的个人信息侵权风险，紧缩监管企业将存在门槛过高、合规困难、成本艰巨等难题。比较域外模式，结合当前应用场景，多重治理成为最优路径：依据数据种类分级保护，构建全过程数据质量监管、信用评估与标准共享多机制保护体系，并由应用场景主体共同实施“敏捷治理”以实现多元联动，最终实现身联网场景下数据应用与个人信息保护动态平衡，赋能数字社会发展。 |

| Balancing Data Utilization and Personal Information Protection in Body Internet of Things Scenarios in the Digital Age |

| Abstract:Digital technology is revolutionizing human cognition and social interaction. The Internet of Bodies (IoB) generates data with individual, corporate, and societal dimensions. Balancing personal information protection and societal benefits is challenged due to the lack of targeted regulations. Either lenient or stringent regulation poses risks: the former threatens individuals’ personal information, while the latter may impose excessive compliance burdens on enterprises. Examining overseas models and considering current applications, a multi-governance approach is deemed optimal. This involves graded protection based on data types, establishing comprehensive data-quality regulation, credit evaluation, and standard-sharing mechanisms, and implementing “agile governance” by application-specific entities to ensure multi-stakeholder collaboration. The aim is to achieve a dynamic balance between data utilization and personal information protection in the IoB context, thereby driving digital-society development. |
