中文摘要:相关市场界定是反垄断法实施中的关键环节与重要步骤，在反垄断法的实施中具有非常广泛的作用。相关市场界定不仅有助于反垄断执法机关和司法机关明确涉案企业的竞争关系、竞争市场参与者、评估市场力，而且有助于反垄断执法机关筛选案件、陈述案情，有助于反垄断执法机关提高办案效率。目前我国反垄断理论界、实务部门对相关市场界定的地位与作用的认识存在明显分歧，需要《关于相关市场界定的指南》或更高级的法律规范予以澄清。

On the Relevant Market Definition's Position and Role in Anti-monopoly Cases

Abstract:Relevant market definition is an essential step and is used extensively in the implementation of anti-monopoly act. Delineating relevant market can not only facilitate anti-monopoly enforcement agencies and courts to identify relevant competitors, the area of competition, and the market power, but also can help anti-monopoly authorities to classify competitive situation and add clarity and power to the narrative of many anti-monopoly cases, hence beneficial to enhance the enforcement efficiency. There are great disagreements on the relevant market definition's position and role among the antitrust academic circles and the practitioner, which are needed to clarify by regulation such as Guide on the Definition of the Relevant Market or other rules.
