中文摘要:土地是农民生存的基础，也是农业发展最基本的生产资料。2012年12月31日出台的“中央一号”文件，提出要稳定土地承包关系，坚持依法自愿有偿原则，鼓励和支持承包土地向专业大户、家庭农场、农民合作社流转，发展多种形式的适度规模经营，引导农村土地经营权有序流转。对农村土地流转制度中所体现的财产权、发展权、自由平等权进行论述，以期对促进农业产业化经营、规模化经营，实现强农惠农富农，最终实现我国经济全面协调可持续的发展提供理论支持。

The Analysis of the Rights in the Rural Land Circulation System

Abstract:The land is the survival foundation of farmers, but also the basic production resource of agricultural development. "Document NO.1 of the Central Government" that launched in December 31, 2012, propose to stabilize the land contract relations, uphold the principle of voluntary paid according to law, encourage and support of contracted land to the professional major, transfer of the family farm, farmers cooperatives, develop diverse forms of moderate scale management and guide the right of rural land circulation. They are analyzed embodied in the rural land transfer system of property rights, the right to development and the right to equality and freedom, in order to promote the industrialized operation of agriculture, the scale of operation, strengthen agriculture, benefit farmers and eventual provide theoretical support for the realization of China's economic comprehensive, coordinated and sustainable development.
