中文摘要:产品缺陷是产品责任构成要件之一，就产品责任归责原则所生分歧实与产品缺陷有利害关系。产品责任应当贯彻无过错责任原则：第一，无过错责任原则的出现是历史的进步，具有重要价值；第二，无论是何种类型的缺陷产品致害，均应适用无过错责任原则；第三，存在产品缺陷时的责任减免事由，并不违背无过错责任原则。

On Product Defects and Principle of Liability without Fault

Abstract:Product defect is one of the constitution elements of product liability, and which principles should be choose to deal with product liability are referring to product defects. The principle of liability without fault should be adopted: firstly, this principle is highly valued as a landmark of the product development history; secondly, no matter what kind of damages caused by product defects, this principle can be adopted; thirdly, liability waiver subjects when some product defects exist do not violate the principle of liability without fault.
